WARRANTY

LaserHIT LLC warrants to the original retail purchaser (“Consumer”) that all LaserHIT LLC training kits and accessories (“Product”) will under normal use operate substantially in accordance with the accompanying documentation for period specified below from date of original purchase.

Consumer's sole and exclusive remedy, and LaserHIT's sole and exclusive responsibility under this warranty will be, at LaserHIT's option, either to repair the defective Product, to replace it with a new or remanufactured Product of equal value, or to refund the original purchase price (excluding shipping costs). Any replacement may be new or remanufactured. If LaserHIT determines, in its sole discretion, that replacement is not reasonable, a refund may be issued.

Warranty Period

LaserHIT training kit and accessories – One (1) year

1. The foregoing warranty is limited and is not applicable to: (i) disposable items such as paper or cardboard targets, replaceable laser cartridge caps, and custom-caliber shells; (ii) normal wear and tear; (iii) damage caused by misuse, neglect, accident, abuse, alteration, unusual stress, or improper storage; (iv) defects or damage caused by modification, improper or unauthorized repair, installation, wiring, or testing; (v) use of the Product not in accordance with provided documentation; (vi) use with non-approved devices or damage caused by equipment with which the Product is used; (vii) exposure to liquids, submersion, moisture, food or drink spills, fire, or collision; (viii) damage resulting from natural disasters or acts of nature, including but not limited to flood, tornado, earthquake, or hurricane; (ix) products with serial numbers that have been removed, defaced, or altered.

2. To obtain warranty service for any Product that is subject to the foregoing warranty, Consumer must contact LaserHIT to request a Return Material Authorization (“RMA”). The defective Product, proof of purchase, and RMA must then be shipped to the address provided by LaserHIT. Consumer shall bear the cost of shipping the Product to LaserHIT. LaserHIT shall bear the cost of shipping the Product back to the Consumer after the completion of service under this limited warranty. Any Product returned without an RMA or proof of purchase will be returned at Consumer’s expense.

3. This warranty extends only to the original Consumer and is not transferable. THE LIMITED WARRANTY IS PROVIDED IN PLACE OF ALL OTHER WARRANTIES. LaserHIT HEREBY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, QUALITY, AND TITLE. LaserHIT DOES NOT WARRANT THAT THE PRODUCT WILL BE ERROR-FREE OR UNINTERRUPTED. To the extent LaserHIT may not, as a matter of applicable law, disclaim certain implied warranties, the duration of any implied warranty shall be limited to the shorter of the limited warranty period or the minimum time period permitted under such law. Some states do not allow limitations on the duration of implied warranties, so the above limitation may not apply to Consumer. This limited warranty gives Consumer specific legal rights, and Consumer may also have other rights that vary from state to state.

4. IN NO EVENT WILL LaserHIT BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO: LOSS OF PROFITS OR REVENUE, LOSS OF DATA, LOSS OF USE OF THE PRODUCT OR ANY ASSOCIATED EQUIPMENT, COST OF SUBSTITUTE EQUIPMENT OR REPLACEMENT GOODS, LOSS OF USE DURING THE PERIOD THE PRODUCT IS BEING REPAIRED, OR CLAIMS OF THIRD PARTIES - REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL OR EQUITABLE THEORY, EVEN IF LaserHIT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL LaserHIT's TOTAL CUMULATIVE LIABILITY EXCEED THE PURCHASE PRICE PAID BY CONSUMER FOR THE PRODUCT. Some states do not allow the exclusions or limitations of incidental or consequential damages, so these limitations may not apply to Consumer.

5. This Limited Warranty is governed by, and construed under, the laws of the State of Nevada, without regard to its conflict of law principles. Any disputes arising under or relating to this warranty shall be subject to the exclusive jurisdiction of the state and federal courts located in Clark County, Nevada.
